These terms apply when you use drivemyway.co.uk or the Drive My Way app.

Drive My Way is a trading name of Dale Willetts, a sole trader based in Gloucester, England. "We" and "us" in these terms means Drive My Way. Contact: admin@drivemyway.co.uk.

1. Who these terms apply to

Drive My Way is used by two kinds of account:

  • Instructors and driving schoolswho sign up for an account, run their diary, and add their own pupils.
  • Pupilswho are invited by their own instructor and use the app under that instructor's account.

If you're a pupil, your relationship for lessons, bookings and payments is with your instructor, not with Drive My Way directly. We just provide the app they use.

2. Creating an account

Instructors and driving schools create an account in the Drive My Way Control Centre; pupils are added by their instructor. You must provide accurate information and keep your login details secure. Accounts may not be shared between people.

3. Acceptable use

You must not use the service for anything illegal or harmful, try to gain unauthorised access to any account or data that isn't yours, upload anything offensive or that infringes someone else's rights, or share your account with other people.

4. Instructor & driving school responsibilities

As the data controller for your own pupils' information (see our Privacy Policy), you're responsible for having a lawful basis to collect and use it, telling your pupils how their data is used, and responding to their data-protection requests. Drive My Way processes that data on your instructions, as your data processor, under the data processing terms in section 12.

5. Service availability

We aim to keep Drive My Way available and reliable, but the service is provided "as is" without guaranteeing uninterrupted availability. Live location tracking depends on the pupil's and instructor's own devices, network connectivity and third-party mapping services, and may not always be available.

6. Our right to suspend or remove accounts

We can suspend or remove an account if you provide false information, are abusive or threatening towards us or other users, misuse the platform, or breach these terms.

7. Pricing & billing

Pupil accounts are free. Instructors and driving schools pay a monthly subscription. Current prices are shown in Pricing: solo instructors £11.99 a month; driving schools £13.99 a month plus £9.99 for each extra instructor. Premium (Learning Videos and Theory & Hazard Perception for your pupils, and your own logo and driving school name in the pupil app) adds £2 a month, and for a driving school that is on the base and on every instructor seat.

Where billing happens. Signing up, choosing your plan, setting up your Direct Debit, changing seats or plan, and cancelling are all done in the Drive My Way Control Centre at web.drivemyway.co.uk. The app does not take payments or sign-ups.

Free trial. New accounts get 30 days free with every feature, Premium included. No bank details are needed to start, and nothing is charged during the trial.

After the trial. To keep using Drive My Way, choose Basic or Premium and set up a Direct Debit in the Control Centre before your trial ends. Payments are taken monthly by Direct Debit through our payment provider, GoCardless. Your first payment is not sent to your bank until your trial has ended. Changes to seats or plan apply from your next payment.

If no Direct Debit is set up. If your trial ends without a Direct Debit, your account is paused until one is set up. While it is paused, you, any instructors in your driving school, and your pupils can't use the app, and the Control Centre only lets you sort out billing and download your records. Nothing is deleted straight away (see Deleting paused accounts below).

Failed payments. If a payment fails, you have 7 days to put it right before your account is paused in the same way.

Cancelling. You can cancel any time from Billing in the Control Centre. You keep access until the end of the time you've already paid for, or the end of your free trial. Your Direct Debit stays in place until then, so you can restart with one click, and then we cancel it; you can also cancel it with your bank at any time. Cancelling also cancels any payment that hasn't yet been sent to your bank. A Direct Debit is sent to your bank 2 working days before it is taken, and once sent it can't be stopped; if that happens we'll tell you, and that payment covers you for the month it pays for.

Moving from Premium to Basic. Your pupils lose Learning Videos and Theory & Hazard Perception, and their theory practice progress is removed 30 days later. They see the Drive My Way name and logo instead of yours; your logo and driving school name stay saved and show again if you move back to Premium.

Deleting paused accounts. If your account was never paid for, it is deleted 90 days after your free trial ended. If it was paid for before, it is kept for 12 months from when it was paused, then deleted. We email you at least 30 days before, and you can ask us to delete it sooner. Deleting removes your account, any instructors in your driving school, your pupils and their records, lessons, messages and finances, and can't be undone. Our own records of your subscription payments are kept for as long as tax law requires.

Websites and pass walls. These are one-off purchases, not part of your subscription, bought from the Website tab in the Control Centre. A website is free for the first 30 dayscancel any time in that period from the Website tab and nothing is taken. The pass wall is collected within a few working days of purchase; if you change your mind within 14 days you can refund it in full from the same place. Where we have agreed a price with you directly, that price is collected in the normal way and the 30 days do not apply.

These are business purchases. You buy a website or a pass wall as a driving instructor or driving school, for your business, so the statutory cancellation rights that protect consumers buying at a distance do not apply to them. The 30 days on a website and the 14 days on a pass wall are our own policy rather than anything the law requires of us, and we will hold ourselves to them.

After that. The purchase is non-refundable. Your website and pass wall are published for as long as you have an active Drive My Way subscription. If your subscription ends, or a payment is not put right, they stop being published 30 days later. We email you first, with the date. Nothing is deleted: your design, your words and your photos are kept, and it all comes back exactly as it was if you return.

What stays yours. Your own web address is registered in your name and remains yours whatever happens to your Drive My Way account. So does everything you wrote and every photo you uploaded, and you can download a copy of all of it at any time from the Website tab. The website design itself, and the software behind it, remain ours and are not transferred with the purchase.

Pass photos and consent. A pupil's pass photo is only published where that pupil has agreed, and they can withdraw at any time using a link we email them. When they do, the photo comes off your pass wall straight away and the picture is deleted. Anywhere else you have used it, social media, for instance, is outside our reach, so we email you to say which places they had agreed to, and taking it down from those is down to you. We keep a record of what each pupil agreed to and when, including after their pupil record has been deleted, for as long as their photo is published.

Refer a friend. Your Control Centre Billing page has your own referral link and code. When a new driving instructor or driving school signs up with it and has made 3 monthly payments on their own subscription, you get your own base price off one monthly payment: £11.99 (£13.99 on Premium) for a solo instructor, or £13.99 (£15.99 on Premium) for a driving school, where extra instructor seats are still charged. It doesn't apply to instructors joining your own driving school, to your own email address or bank account, or if you've cancelled by the time it's earned. Rewards are taken off your next payment that can still be changed, one per month, and have no cash value. We may change or end the scheme; rewards already earned are honoured.

8. Content and intellectual property

The Drive My Way app, website, and any resources/videos we provide belong to Drive My Way. You may not copy, resell or redistribute them. Content instructors add themselves (pupil records, messages, their own resources) remains theirs.

9. Liability

We provide the website and app on an "as is" basis and aren't liable for any loss arising from your use of them, except where the law doesn't allow us to exclude liability (for example death or personal injury caused by our negligence).

Theory and hazard perception practice. This is revision material, not an official DVSA product. The questions are written from the Highway Code, which is what the real test is based on; they are not DVSA's own licensed questions, and the hazard clips are ours rather than the official ones. Drive My Way is not affiliated with, endorsed by, or approved by DVSA or any government body. Scores in the app, including a pass on a mock test at the real 43/50 mark, are a guide to how revision is going and are not a prediction of the real result. We are not liable for the outcome of anyone's theory, hazard perception or practical test, or for the cost of retaking one.

10. Changes

We may update these terms. Continued use of the website or app after changes means you accept the new terms.

11. Governing law

These terms are governed by the laws of England and Wales.

12. Data processing terms (pupil data)

This section covers the pupils' details that instructors and driving schools keep in Drive My Way. For that data you are the data controller and Drive My Way is your data processor, and this section is the contract between us that UK GDPR (Article 28) requires. Your own account and billing details are covered by our Privacy Policy instead, where Drive My Way is the controller.

What we process, and why. Your pupils' names, contact details, address and date of birth; licence details if they're added; lessons, availability, progress notes and reflective logs; theory and hazard perception practice results; messages; payments and lesson credit; and your live location during an "on the way" trip. We process it while you have an account, and only to provide Drive My Way to you, your instructors and your pupils: storing it, showing it in the app and the Control Centre, sending notifications and emails, and keeping backups.

Only on your instructions. We only use pupil data on your instructions. Your instructions are these terms, what you do in the app and the Control Centre (for example adding, changing or deleting a pupil), and anything you ask us in writing from your account's email address (for a driving school, from its administrator). We never sell pupil data or use it for our own marketing. If the law requires us to use it in any other way, for example because of a court order, we'll tell you first unless the law forbids it.

Confidentiality. Only Drive My Way's administrators can reach pupil data, only when it's needed to run the service or support your account, and they must keep it confidential.

Security. We protect pupil data with encrypted connections, database rules that let each account reach only its own pupils, optional two-factor authentication on logins, and providers that encrypt the data they store. Backups are kept for up to 6 months, then deleted automatically.

Other companies we use. You agree that we use these companies to run the service. Each is bound by data protection terms that protect the data at least as well as these, and we remain responsible to you for them:

  • Supabase: database, file storage and logins
  • Cloudflare: backups and learning video storage
  • Resend and Zoho: sending emails
  • Apple and Google: push notifications
  • Mapbox: maps for "on the way" trips
  • Google Maps: the aerial map in Road Sketch
  • GoCardless: Direct Debit payments
  • Vercel: hosting the Control Centre and this website

We'll email account holders at least 30 days before another company starts handling pupil data. If you object, you can cancel your subscription. Some of these companies may handle data outside the UK. When they do, it's protected by UK adequacy regulations or the UK's approved data transfer contract terms.

Helping you with your pupils' rights. If a pupil contacts us about their data, we'll pass the request to you rather than answer it ourselves. We'll help you respond to pupils' requests (most you can do yourself in the Control Centre, for example Download my pupils) and answer your questions about how Drive My Way handles their data.

If something goes wrong. If we become aware of a breach affecting your pupils' data, we'll tell you without undue delay, with what we know, so you can decide whether to report it to the Information Commissioner's Office. Controllers must usually do that within 72 hours.

What's cleared automatically while your account is open. These rules are the same for every instructor and driving school:

  • When you mark a pupil as passed: their lessons (apart from the driving test), messages, progress, reflective logs, contact details, date of birth, licence details and app login are deleted. Their name, their payments and their driving test result are kept for your records.
  • When you mark a pupil as inactive: the app is switched off for them straight away and they only see a message asking them to contact you. If their last driving test was a fail you are asked what you would like to happen: you can leave their messages and Test Booking & Resources open so they can get back in touch and book their practical test around your diary, or close the app to them completely. You can turn either off later from their profile. Everything comes back if you make them active again.
  • A pupil who has been inactive for a year: their lessons, messages, progress and reflective logs are deleted, their phone number, email, address, date of birth, licence details and other personal details are cleared, their app login is switched off for good, and their driving test records no longer show who they were. Their name and payments are kept. Nobody is cleared without warning: after eleven months you are told, and a pupil still using the app is asked whether they still want their account. You have thirty days, and you can keep the record for another three months as many times as you need to.
  • 6 years after a pupil's last payment (for inactive, passed or declined pupils): the pupil record is removed. Their payments stay in your finances with the pupil's name in the note.
  • Finance records, including pupil payments, are deleted once UK tax law no longer needs them kept (see section 5 of our Privacy Policy).

When your account ends. You can download your pupils and your finances from the Control Centre at any time, including while your account is paused. When your account is deleted (see Deleting paused accounts in section 7, or when you ask us to), everything about your pupils is deleted, including their names, payments and driving test results, and it's gone from backups within 6 months. Drive My Way keeps only its own record of your subscription payments, which holds no pupil details.

Showing we keep to these terms. We'll give you the information you reasonably need to show we're meeting these terms, answer your questions about it, and allow reasonable audits with reasonable notice.
